Don't be silly!
he'll just bounce right back after insurance claim, what you wanna do is ruin his bush mechanic business so no one would wanna deal with him ever again.

sorry to hear mate.

bring a voice recorder with u to the mechanic. then ask him again what he had done to the old engine that caused u to pay for a "new" one. if the story is the same, well then he is screwed either way, since he left ur motor outside and caused it to get damaged. that itself is his fault and he should reimburse u or get u a brand new motor to fit. Ignorance and clumsiness is not an argument that can be used in court.

now if he tells u another story u can tell him that he lied to u about what happened......im sure at this point he will make up all this s**t which u have recorded. he'll probably end up saying oh ive mistaken u to someone else. and if the stories keep coming out wrong then of course he has lied all the way through. at some point he will keep lying and keep going around in circles.

so long as u have it all recorded u can always track back and find weak points to screw him up.

use the recording if u go to court......

even better if u can get a clip like ACA use to screw people over.

if u do go to court and win. make him repay u the 4000 bux, as well as the solicitor u had to hire, and court fees and such.

anyways hope that was a way to get some evidence for court actions.

good luck

just a warning.

a tape recorder can't be used in court unless the other party was aware of the recording.

eg you go to mechanic with tape recorder hidden in your jacket and ask questions and not tell him that he is being recorded, if you try use the tape as evidance in court the judge wont allow it.

1. take all your reciepts and documentation from the mechanic, to an independant motoring body, get the engine throughly inspected, show the motoring body the reciepts, and ask them to write you a letter detailing their findings

2. get all your paperwork together, the letter from the motoring body, and a letter from anyone who was present when you spoke to this guy who can confirm or deny details in court...

3. get a lawyer and explore your options

4. if its a small town, tell everyone what happened.....word of mouth will pass around quickly, he wont have any business after that.

beautifully said. Now lock this thread so that last pit of advice from "x3ros" doesn't get berried in all the other posting.
