If you hav either a scanner or cb/scanner can the police tell if you are listening to them (i.e)if being followed or drive past a police car can they tell like they know if you are operating a radar detector?

I dont think the law has changed in NSW, but its not an offence to listen only if you make money from it.

kinda right there, except it extends to using it for personal gain, ie. evading police and if they wanna be pricks they can say you are listening to it for entertainment which is personal gain, but you would have to be stopped by a cop in a real bad mood to be hit with that. all goverment freq's are publicly listed so you are allowed to listen to them, of cause army and asio kinda stuff isnt listed, lol.

i belive in qld it is the only state where it is illegal to listen to the police radio? they use a digital signal so ive been told...
and it is also not illegal to listen in, but as someon else not, not for personal gain, and you are not allowed to act on any information heard so ive been told. i dont think they can tell unless they physically see the scanner, a radar detector sends out laser and radar signal to detect radars, thus being detectable. scanners on the other hand, are only recieving unprotected free air signal which are going in any direction, so they ar enot aimed anywhere, so no, they wouldnt be able to, unless you press your little button which plays that funny be blop be what ever sound

It is not illegal to listen to police chatter on either a scanner or scanning transceiver, it IS illegal to transmit on the designated frequencies.
The act that covers the use and abuse of transmitting devices is the telecommunications act, and as the police frequencies are in a range that is designated commercial, you can listen in. As was ststed before, it is illegal to use information for personal gain, but that is for things like hearing that ther is a fire somewhere and going along to raid the pantry while the owners aren't home. Tow truck companies are freely allowed to listen in to scanners for the location of accidents, etc but that is not 'personal gain' that is commercial gain and these are commercial frequencies...... My missus was a copper for 12 years, I have to tahnk her for her input.

Fat lot of good my standard UHF Scanner has been up here in Brisbane as I found out the Police use Digital and I would have to upgrade to a fancier and more costly unit to hear them up here!

I had no problems monitoring all digital police communications last time I was in Victoria.
