According to a news item today our Dear Leaders in Rannistan has decided it is soon to be illegal to be a hoon on your own private property and the police will not require a warrant to enter your property and seize your vehicle if caught doing so, impounding it and expecting you to pay money for its return after a longer period of impoundment. It won't be long until the other states bring in the same laws to be 'tough on hoons' and increase road safety. Read the story here.

Does that mean skid pans and race tracks need a different license now to accomodate burn outs, excess speeds and aggressive driving?

this is a great idea and i applaud the SA government.
over 500 bazillion people are killed each year cutting backyard hoops, more then are killed by mice, oranges, clouds, dolphins and small pebbles combined. heads up though, if you've got a crop, exnay on the garage skiday. /sarcasm (as scary as the thought is, i know some of you will miss it)

I wonder if by "private property" they are referring to someone else's property, not your own farm/yard/etc. I imagine many carparks and other open bitumen areas are public access but private property (ie owned by Maccas, Westfield and the like). I'm not a lawyer but it may be hard to prosecute people on this type of property. With the number of idiots posting videos of themselves doing burnouts while little kids walk around and people push shopping trolleys through the smoke I'm not surprised it's a topic the government is interested in.
It then makes sense that they can impound you car on that property even if its not a public road. Or if you get caught by a camera, or a Youtube video for that matter, the police should be able to go and impound the car after the event, whether it's on your property or someone elses. A tough policy is useless if it cannot be enforced. Circle work on your farm is a completely different issue and not one that I think poses any danger. Most of us like cutting loose sometimes but you have to admit, it's frustrating that every young male with a modified car is labelled a hoon and pays crazy insurance premiums because 1% of people choose to get their kicks in stupid places. If the new rules take this 1% off the road and the rest of us get treated a little better as a result, then I suppose it's a good thing. I may be completely wrong, but it's just a different perspective. |

I may be completely wrong, but it's just a different perspective. i agree, but i highly doubt the goverment to think intelligently like this. they will take this and ruin it for everyone... if the hooning is on private property, then shouldnt the owners of that property choose to press charges or not?

A good Ford loving mate, and his Holden driving sidekick, recently got done in Wellington, NZ for drunk driving, sustained loss of traction and picking noses in public.
Loss of license, probation and supervision and both cars impounded for a month. Fair enough you say. But wait - They were on a privately owned car park (the front of NZEA's house as it happens) and no matter what you say, the law states something like "ANY PLACE THE PUBLIC HAS ACCESS TO BY RIGHT OR NOT". Therefore, unless you are behind a 8 foot high barbed wire fence with notices stating "keep the f**k out because the dogs bite is worse than his bark" you are going to get completely screwed - Even if you're on your own driveway out the back of your own house you can (apparently) get these pricks turning up and taking away your car and license. It's just silly. 100% bone stupid. |

I'm sure "Private" car parks are still subject to normal traffic law without the SA tackon (although South Australias are notoriously behind the 8 ball, mostly because of all the weed, so who knows). This is grapevine s**t so take it with a pinch of salt, but something about the public access side of things that defines it as subject or not subject to traffic law. (edit: what fiend said rings a bell and is what i'm referring too) Not that it means much either way, governments love new laws. If they didn't make new laws then they'd have to admit that the problem is in the enforcement, and actually doing something is harder (and more expensive) then appearing to do something. Interesting choice of words in referring to "hoons" as "1%" too, considering who wears that with moniker pride. could be prophetic??

Global Totalisum is on the move and it's showing it's ugly head day by day. one way to do that is impose strict laws through disguised reforms and psychological conditioning for a more obedient meekly society.
It starts off with just a little nibble with the war on hoons, exposing the ignorant to media conditioning in ways that it appears to be a overwhelming crisis on our roads. it enrages the dummies for the authorities to act. once the submission to authority is in place, everything else follows like a domino effect. but on flip side, lets have more drugs, alcohol related road fatalities by being inactive in other areas like gang and drug related chaos in suburbia. they'll leave that alone until until full submission of helplessness is archive, then they'll appear to be the saviours. but for now, just small slicing and dicing here for now. Classic case and it's true.

I thought this is similar to a law already in force in VIC and NSW.
It came in with the original hoon laws. It went above the usual public nuisance laws because it allowed the cops to immediately seize vehicles on private property, if the owner of the property allowed it. http://www.legislation.vic.gov.au/Domino/Web_Notes/LDMS/LTObject_Store/LTObjSt3.nsf/DDE300B846EED9C7CA257616000A3571/4FBD7416245B23A4CA257761002C2446/$FILE/86-127a113.pdf Section 84G of the legislation allows for this. So if you do a burnout in a Westfield carpark, and Westfield have given blanket agreement to allow cops to seize cars on their property, then car go bye bye. It may be the newspaper has left out important tid-bits that explain it fully, which really wouldn't be like them. I know of one country FM member who was subjected to this on a farm. The cop let him off, but warned him about doing it in view of the road again. Next time his car would be taken. |

few too many bogans have probably ripped a brakey in their driveway infront of the cops, i can totally understand this in residential areas, but as of usual the law will be written to stop one thing and applied like a blanket to so many others.
