i had a water leak bout a 2 weeks ago and had my water pump replaced. thought all my water problems were gone but tody i lost bout 3 liters of water again. no signs of a leak on the ground and no milky oil, if it is a head gasket how would i tell and if not what else could it be?

look at the back of the block (exhaust side) if its wet theres a chance its leaking and its evaporating from exhaust heat before it hits the ground.
Are you using coolant? (glycol) if so, can you smell it? If you are again, look for a whiteish green residue on the sump gasket. Have you checked the radiator cap? if its playing up... it could be leaking out the overflow. (zip tie a coke® bottle to the overflow pipe and take it for a drive) thats just a few. be sure to check all pipes and radiator for evidents of leaks and also check for excess steam from the exhaust

its to dark to check the block at the moment
i was using coolant but i don't know what it smells like and i have a s**t sense of smell the radiator cap could be replaced it has leaked in the past and i think its safe to say that it was i bit excessive but could that cause such a large water loss not sure bout the steam factor it seem ok at running temp but car does run a bit eraticly in the temp department

Remove the heat shield from the exhaust manifold and check behind there.
My EL was leaking out of the headgasket between 4 & 5, Coolant was never visable as it evaporated before getting to the floor.

have to have a look under the heat shield, could you tell me if the correct coolant is a clear colour and what is the red/brown crap that coats the inside of my coolant bottle

Coolant is usually a bright green colour. Ford also do a pink. The red/brown crap thats inside your coolant bottle is likely to be red oxide or rust! Sounds like your cooling system needs a good clean out and new coolant.
